{"id":1132,"date":"2009-12-17T10:32:50","date_gmt":"2009-12-17T15:32:50","guid":{"rendered":"https:\/\/planesafe.org\/?page_id=1132"},"modified":"2009-12-17T12:39:15","modified_gmt":"2009-12-17T17:39:15","slug":"icing-lawsuit","status":"publish","type":"page","link":"https:\/\/planesafe.org\/?page_id=1132","title":{"rendered":"ICING LAWSUIT"},"content":{"rendered":"<table>\n<tr>\n<td><img decoding=\"async\" src=\"images\/Dejavu_A_001.jpg\" align=\"left\" style=\"border-width:1px;border-style:solid;\">\n<\/td>\n<td>\n<strong><br \/>\nICING\u00a0 Lawsuit filed February 24, 2009<\/strong> and <strong>Press Conferences<\/strong> held February 23 and 24, 2009 at New\u00a0Jersey, Washington DC, and Buffalo NY\u00a0to demand an end to &#8220;d\u00e8j\u00e1 v\u00f9 disasters.&#8221;\u00a0\n<\/td>\n<\/tr>\n<\/table>\n<p clear=\"both\">\n<div style=\"border-style:solid;border-width:1px;border-color:black;\"><center>Gail Dunham, Executive Director of the National Air Disaster Alliance\/Foundation,<br \/>\nin per personal capacity, PLAINTIFF<br \/>\nvs.<br \/>\nRay H LaHood, U.S. Secretary of Transportation, and<br \/>\nLynne A Osmus, Acting Administrator, Federal Aviation Administration, DEFENDANTS<br \/>\n<\/center><\/div>\n<\/p>\n<p>\nLawsuit was filed to compel government officials to move forward Icing Regulations to prevent aviation disasters such as the following, and more:<br \/>\n<\/P><\/p>\n<table border=\"0\">\n<tr>\n<td>Continental Connection<\/td>\n<td>February 12, 2009<\/td>\n<td>Buffalo NY<\/td>\n<\/tr>\n<tr>\n<td>American Eagle 4184<\/td>\n<td>Halloween, October 31, 1994<\/td>\n<td>Roselawn IN<\/td>\n<\/tr>\n<tr>\n<td>Comair 3272<\/td>\n<td>January 9, 1997<\/td>\n<td>Monroe MI<\/td>\n<\/tr>\n<tr>\n<td>Canadair, Global Air 73 (Ebersol crash)<\/td>\n<td>November 28, 2004<\/td>\n<td>Montrose CO<\/td>\n<\/tr>\n<tr>\n<td>Platinum Jet Management<\/td>\n<td>February 2, 2005<\/td>\n<td>Teterboro NJ<\/td>\n<\/tr>\n<tr>\n<td colspan=\"3\"><center><span style=\"font-size:8pt;\">(Indictments and convictions followed the Teterboro investigation)<\/span><\/center><\/td>\n<\/tr>\n<tr>\n<td>Martin Air, Cessna (the Circuit City crash)<\/td>\n<td>February 16, 2005<\/td>\n<td>Pueblo CO<\/td>\n<\/tr>\n<\/table>\n<p><\/p>\n<p clear=\"both\">\nThe NTSB and the public blamed the pilots of prior Colgan Air and Pinnacle crashes, Colgan flight 9446 and Pinnacle flight 3701, but subsequent litigation showed the aircraft in each case was to blame.\n<\/p>\n<p>Rushing to \u201cblame the pilots and close the case instead of a complete examination of the aircraft will cause more loss of life in the future.<\/p>\n<p>In addition to the inaction on icing, airport safety issues have been pending for 19 years without DOT\/FAA action.\u00a0 <em>NADA\/F<\/em> was founded by air crash survivors and family members in 1996, and our work is in memory of those who died, and to prevent these devastating disasters in the future.<\/p>\n<p>Thank you to the family members from CO3407, and other icing disasters, for their diligence to push the FAA and government officials to mandate safety improvements to end the fatal flaws that caused too many aviation icing and commuter plane disasters.\u00a0Thank you to Mary Schiavo and Don McCune with <a href=\"http:\/\/www.MotleyRice.com\">http:\/\/www.MotleyRice.com<\/a> for the excellent legal work.<\/p>\n<p>Documents show that the FAA was not going to release Icing Rulemaking documents until 2010, or later, and continue the 15+ years of delay.\u00a0<\/p>\n<p><strong>August 3, 2009 the FAA did publish a Final Rule<\/strong>\u00a0 \u201cTo amend the airworthiness standards applicable to transport category airplanes certificated for flight in icing conditions. The rule requires a means to ensure timely activation of the airframe ice protection system. This rule is the result of information gathered from a review of icing accidents and incidents, and will improve the level of safety for new airplane designs for operations in icing conditions.\u201d\u00a0<\/p>\n<p>The Rulemaking is important, but there is still much work to do, and the FAA should be ashamed of the lengthy timeline allowed for compliance, lack of oversight of certification and no additional rulemaking.<\/p>\n<p><strong>August 2009 <em>NADA\/F <\/em>withdrew the lawsuit as the FAA had published rulemaking<\/strong>, and Lynne Osmus had left the FAA, and we did not want to Amend the lawsuit to sue the new FAA Administrator Randy Babbitt.\u00a0 Babbitt is working very hard to improve the safety culture at the FAA, and we want to work with him as we share similar goals.\u00a0<\/p>\n<p><em>NADA\/F<\/em> can re-instate the lawsuit at anytime.\u00a0<\/p>\n<p>One in every four\u00a0 U.S. passengers flies a commuter airline, yet 7 or the last 8 fatal disasters in the U.S. involved smaller carriers.<\/p>\n<p>Certification.\u00a0 The CO3407 was a Q-400, Dash-8, and major design changes were just grand\u2011fathered in from the original 100 series.\u00a0 The Dash-8 did not have the thorough Certification process by the FAA that should be mandated for all aircraft.<\/p>\n<p>A long pilot commute was also blamed for CO3407 because the cockpit crew members flew to work the flight, however, they could have worked the flight they took to New Jersey and still have been \u201clegal\u201d to work CO3407.\u00a0 Safety is compromised when pilot pay is so low that pilots are eligible for food stamps in some areas of the country.\u00a0 We need action on work\/rest rules, pilot pay, and not just another \u201cstudy.\u201d<\/p>\n<p>The following documents also tell the story:\u00a0<\/p>\n<p><strong><a href=\"http:\/\/planesafe.org\/planesafe_archive\/icing\/FILEDcomplaint09cv370.pdf\">Filed Complaint<\/a><\/strong>:\u00a0 Gail Dunham vs. Ray H LaHood, Secretary of Transportation and Lynne A.
